No. There isn't. Unless they are wielding a weapon. That kid was much smaller than the woman, and you can see in the video her dragging him around. If she had stopped beating/attacking him, he was clearly NOT going to go back after her or harm her. Plus, in charter schools, I'm sure they have security. I don't know of any school that doesn't have security.

In what probable instance do you think assaulting a child is justified?

If that was my kid, I would absolutely be pressing child. But the kid would also be in trouble for what the heck he did to cause that.
*raises hand* The high school I went to doesn't have security. Small town school with maybe 400 students in it. Most of the charter schools I've seen are really small so maybe there is no security?

I found a TON of articles that all have different information in them concerning this story. A quick rundown of what I think are important points then I'll post links: the charter school is for emotionally troubled and neglected children, the teacher thought that the kid was picking on a special needs girl in the classroom, there was actually an arrest warrant out for the teacher for a criminal mischief charge, there were three (3) other teachers standing by watching her whale on the kid, the parent of the kid is suing both the teacher and the school district and one of the teachers who supposedly witnessed the event and did not report it has resigned from the school.

Thank you very much for posting these updates Tagroy :) I do appreciate it! I am very happy to know charges are being pressed, and an arrest warrant was issued.

The court can sort out the details and figure out if she was justified. I don't know that I agree with the mother suing the school though, I'd have to know more details on that one to decide.

I will be reading those links shortly :D

Charter schools are usually for kids who aren't doing well in regular school, right? I assume a school designed for troubled kids has security, but even if not, I'm sure there are a number of adults in that building that would help the teacher out.

The teacher wasn't fighting the kid. She was beating and attacking him while he just sat/lied there.

If a kid starts beating the crap out of a teacher or adult, sure it's acceptable to fight back/defend yourself. But the second that kid stops being a physical threat should be the second the teacher takes her hands off.

As far as the suing goes, any person that will be working in proximity to children has to undergo a background check to make sure they're not child molesters or have a history of abuse, etc. It could be that they neglected to do so when they hired this teacher. I don't know if the warrant was issued before or after she was hired. If it was before, and if she has a record of assaults or something on those lines then I'd be supporting the mom suing the school.

If the school took all those measures, then they did everything in their power required to make sure the people teaching the kids were not goons, and this woman slipped through anyway.

Sounds like a crappy environment to work in anyway. I've worked in charter schools before. Some were amazing and well organized. Others were sort of thrown together and didn't really have clear disciplinary guidelines set up, among other things. I didn't stay with those schools long.

That is what I mean. If the school took all precautions with background checks, reference checks, and this woman passed them all, then I see no reason to sue the school. The only reason TO sue the school if all those steps were taken, would be the hopes of money, because obviously they would have more to pay than the teacher alone.

The principal can't be everywhere all the time, and these ADULT teachers are supposed to be trusted to function on their own.

Now the issue of other teachers *allegedly* watching this go down and doing nothing to intervene bothers me, but again, that would be on THEM IMO and not the school as a whole. I am very big on individual responsibility and REALLY hate to see blanket rules/judgments on entire groups, businesses, or organizations based on the actions of one or a few. Sort of like BSL if you will, LOL

Exclusive: Houston Teacher Sherri Davis, Accused of Beating Student, Blames Lack of Training - ABC News

another point of view. again I don't condone what she did, but I can see why someone would lose their cool. breaking up one fight only to find this bully picking on a special needs little girl.

Some things that stand out to me.

The "horrified mother" didn't even know of this until weeks later. How does that happen if the "beating" and I use the term loosely was so horrific, how does the mother NOT know. and since she didn't, HOW are we to believer her that the kid had bruises and a black eye?

The kid has a history of violence towards teachers and other students, this probably extends outside the school as well, maybe he got a black eye somewhere else. I mean mom didn't even know for weeks????

mom said this.
It's horrifying," said Johnson last week. "He had bruises on his side where she was kicking him. He had a knot on his head, and he had a black eye."
yeah, that's why you didn't know for weeks after the incident :rofl1:

what really stinks in this whole thing? a deadbeat parent with a kid that needs help will just get money. If you ask me a few bruises are worth a couple hundred bucks, end of story. could probably buy her off with a couple cartons of smokes and some booze. She sounds like such the loving mother.

Ya, the suing crap I don't agree with.........I think it's BS, just a fast paycheck. If the teacher lost her job (obviously she did) and the mother was able to file assault charges, that should be it. I don't see what "beeatch gonna get paaaaaaaaaaaid" has to do with what happened.

of course they sue the school for money, but the apparently sorry excuse for a mother should not be able to profit from her lack of parenting that directly lead to this. and come on, how can you NOT know of a "horrific beating" your kid was given until weeks later if you're doing your job???? and how in the **** do you raise a little dead beat kid to have a history of violence against students, teachers and bullying a special needs girl???? if you're doing your job.

Seriously, if I was on the jury, she'd get 200 bucks for some band aids and ice.
