Georgia lawmaker proposes classifying miscarriages as ‘prenatal murder’ - Yahoo! News

Earlier this year, a furor broke out in Congress over pending House legislation that critics contended would cut off federal funding for abortion in cases involving rape and incest. But that controversy may well pale beside a new proposal before the Georgia House.

Georgia State Rep. Bobby Franklin, a Republican from Marietta, Georgia, has introduced a bill that would criminalize miscarriages, making abortion and miscarriage -- or "prenatal murder" in the language of the bill -- potentially punishable by death.

Reports Mother Jones' Jen Phillips:

Under Rep. Franklin's bill, HB 1, women who miscarry could become felons if they cannot prove that there was "no human involvement whatsoever in the causation" of their miscarriage. There is no clarification of what "human involvement" means, and this is hugely problematic as medical doctors do not know exactly what causes miscarriages. Miscarriages are estimated to terminate up to a quarter of all pregnancies and the Mayo Clinic says that "the actual number is probably much higher because many miscarriages occur so early in pregnancy that a woman doesn't even know she's pregnant. Most miscarriages occur because the fetus isn't developing normally."

Phillips notes that last year Franklin -- a graduate of Covenant College who's served in the Georgia House since 1997 -- proposed a law that would reclassify victims of domestic violence as "accusers." His bio on the Georgia House website describes Franklin "an active member of the Reformed Presbyterian Church" but omits any mention of his marital status. And we were curious to learn whether the author of legislation that extends the state's reach very far into the private lives of women was himself married -- so we called his office to inquire, and staffer Leigh Goff told us she's "not sure" if he is.

Franklin's online bio also states that he "has been called 'the conscience of the Republican Caucus' because he believes that civil government should return to its biblically and constitutionally defined role." The present legislation would hold women women legally responsible for the health and well-being of a fetus from "the moment of conception"-- weeks before modern pregnancy testing can accurately determine whether or not a woman is pregnant. So it seems to follow that Franklin believes government's "biblically and constitutionally defined role" is to hold women criminally liable for nature taking its course in the early days of a pregnancy.

Its not likely to pass, and it would be unconstitutional if it did. But it does show you the mentality of some of these people; they don't just want to protect fetuses (not an unsympathetic desire), they actually hate women. They may not realize that they hate women, but anyone who would investigate a woman for murder after a miscarriage (and keep in mind just how many pregnancies end in miscarriage), particularly with the burden of proof on her, hates women.

That's exactly it, Lil. It's been evident for a long time for anyone willing to see. But you know, very few of their followers are going to do anything other than get right up on that bandwagon with them. Even the women . . .

wow. just wow. Like lil said, I'm not too worried about something like that passing....but the fact that someone who holds a position in Congress has that sort of mentality is just incredibly disturbing. His thought process is just so incredibly ridiculous that I don't even feel compelled to even begin to discuss why...since it hopefully is not necessary.

I read that whole article with my mouth hanging wide open....I'm still just flabbergasted.

I fail to see what is so wrong with this. This man obviously cares a lot about the sanctity of life. Abortion is killing a human being, and as such it is murder. He is just trying to make sure fewer murders take place, and that murderers are punished for their crime. Why is that bad?

I know what a miscarriage is. I also know that what is called a miscarriage isn't always entirely natural; it seems this congressman knows this as well and seeks to protect life as much as possible.

The poor women that would have to deal with this if it passes :(.

To claim they are a murderer for loosing their baby is just wow. I think if someone accussed me of that if I lost Morgan I WOULD be a murderer afterwards.

That is just....................WOW.

I also gotta say I love how its men trying to pass these laws. If you have no clue what its like to be pregnant I dont think you should be passing LAWS governing it.

Im sorry but that is something that you can NEVER know what it feels like until its you even as a husband its not the same.

If they want to blame the woman for a miscarriage they should blame the man as well I mean he didnt protect the baby to the best of his ability then. They could have been having sex and somehow caused it ya know.

Miscarriages are often called "abortions".
I KNOW because when I had a miscarriage, it was medically called an "abortion" because my body physically aborted the fetus/baby/embryo/whatever-you-wish-to-consider-it.

But I never intentionally had an abortion. My body decided it wasn't right. I had no control over it.

Anyway, needless to say, a miscarriage is an often devastating experience for a woman. You think that we A.) want to lose a baby most of us have just come to grips with finding out we're going to have B.) want a living creature DYING inside our bodies?? C.) potentially be found guilty of murder because our bodies do something we have no control over?

This will NEVER pass.

I also gotta say I love how its men trying to pass these laws. If you have no clue what its like to be pregnant I dont think you should be passing LAWS governing it.

You still had an abortion. You say it wasn't intentional. Not all miscarriages/abortions are unintentional; this is aimed at those that are intentional, as those women have committed murder and need to be held accountable for their actions.

I usually stay away from the political threads too, but this is just crazy. I'm pro-life, but a woman cannot control whether she has a miscarriage or not.

I'm pretty sure that Neo is baiting you, folks.

So I'll merely nibble at the bait and remark that not only would many women be emotionally devistated by a murder investigation after losing a baby, and outraged at the violation of what is usually a very private loss, but the miscarriage rate in the early stages of pregnancy is extremely high. (Indeed, in the early stages, the woman may not even have known she was pregnant and may not even but sure that she had a miscarriage. I'm fairly sure I once had a very early miscarriage, but I'll never really know). The costs, both social and monetary, for enforcing such a law would be astronomical, and it would be, as a practical matter, unenforceable.


However, in a way, Neo is right. If you really, really, sincerely believe that harming even a fertilized egg is murder and assault, then this is the natural outcome of that belief. Not only must every miscarriage be investigated as a possible murder, but the failure of a woman to do her utmost to protect and nurture her unborn child is at best, child neglect, if not abuse. Thus, not only must miscarriages be investigated, but so must any "inappropriate" behavior by a pregnant woman, and any deficiencies in the baby after it is born, to make sure those deficiencies are not the result of maternal neglect. Of course to carry all this through would result in women of child bearing age being once again rendered little more than incubators, but hey, some people are ok with that.

Did the mom who drank one too many mountain dews "intentionally" miscarry her child? If a woman forgot her thyroid meds once too many times during pregnancy did she "intentionally" miscarry?
What about the mom who kept taking her prozac before knowing she was pregnant and then didn't quit cold turkey but stepped down her meds - is that miscarriage her fault?

Oh oh!! What about if the embryo was shown to have chromosonal abnormalities, but the woman didn't want the child to begin with and may not have taken the best care of herself, are you going to blame her for those chromosonal abnormalities?

And who's going to pay for all of this to be investigated?

I don't see how you can think that someone dying as a direct result of your actions means you aren't responsible.
