Which of these best defines when the act of rape has occured?

Is it only rape if you're given the date rape drug?

Is it rape when you say no yet he just sticks it right in?

Is it rape when you are drunk and give consent because of alcohol?

Or is there no such thing as rape, and it's just what people do now?

i voted all of the above, but i'm on the fence about the yes while intoxicated. it can go both ways. so much is situational. but i believe that it certainly *can* constitute rape.

I chose the lack of consent option. IMO, if you have been drugged and are out, that is a lack on consent.

When you are intoxicated...eh. You chose to drink, and if you have a fling while out of it due to the fact that you did yourself in...I can't think of that as rape. You don't choose to take a date rape drug, you choose to drink yourself into oblivion, and **** the consequences.

the alcohol thing.. im on the fence. Girls in college especially really make me think twice about it.
I have WITNESSED quite a few times, girls who meet a guy at a party, drink flirt, says she wants to have sex, etc.. etc.. has sex. I have even seen them RIGHT AFTER they do it.. the girl is laughing, smiling, high5ing, all over the guy
and then the next day when she feels like a slut or is embarrased that people saw her or have heard about it..

how is he supposed to know that? EVERYONE at the party is drinking. Its YOUR JOB to not drink so much that you can't control yourself or your actions. NOBODY forced alcohol down your throat.
what..are all guys supposed to carry around breathalizers?

1. don't drink like a crazy person. Alcohol is fun, I get it. but there is no need to overdue it.
2. If you are going to drink like a fish.. be smart about it. have a group of friends, a few of whom aren't drinking so much, WATCH OUT FOR EACH OTHER
3. FRIEND GROUND RULES. Before the night has even begun, if you KNOW you are going to be drinking tell your friends that under no circumstances are you sleeping with a guy and to not let you do it.
Its MUCH easier for your friends to stop you if they had previous permission and don't feel like they are being party poopers.

Ya, if the girl is passed out half concious. I get it. that is taking advantage for a guy to have sex with her.
but I have witnessed and been around MANY parties and for the majority, its NOT LIKE THAT. The girls are acting totally normally (albeit a bit louder and gigglier) and flirting like crazy

I think if she is walking, she is talking, she isn't OBVIOUSLY trashed (falling all over the place, unconsious, throwing up, etc..) and she consents..then that is consent. wether she has been drinking or not.

I voted all, but I'm iffy on the intoxicated issue, too.

For example, what if the guy is also intoxicated? If you're both drunk, you can't say yes then and cry rape later.

And while I think if you're a young woman getting so drunk you don't know your own name, on one hand, you're responsible for your own actions, including the actions you perform or ask for or accept while intoxicated. That being said, I think it's morally wrong for a man to have sex with an extremely intoxicated woman. I'm not sure if I'd consider it rape.

If you give consent when your drunk and it sounds like an awesome idea at the time, and then you regret it the next morning because Mr. Charming is in reality Mr. NastyCrack, well, that's on you. That's not rape, that's a lesson.

Now if you are drunk, start fooling around with a guy and say "no" or "stop", but you are too drunk to scream and fend the guy off- yes, that is rape.

I voted all of the above though I'm a bit iffy about the intoxicated one.

Rape is such a scary subject for me having been a victim of one. But definitely any kind of sex where no consent is given is rape in my opinion

I do not think that sex WITH consent while intoxicated is rape...it is just a decision, which one may wake up thinking was good or bad.

Jules' example of being too drunk to fight the guy off would be without consent, so yes, that is definitely rape.

agreed. I chose the no consent option for the same reason. Being drugged you obviously didn't give consent, but you choose to drink to the point you want to get frisky with everyone, that's your problem. You can't handle the consequences, grow up and learn how to control yourself.

Sex without consent. The reason I didn't choose all of the above is because sex while intoxicated very much a case-by-case basis.

I said sex without consent.
I really don't like the idea of people getting done for rape because they had sex with someone that consesnted while drunk.
I know what I'm like when I'm drunk and its my choice to put myself in that situation. A couple of times I've woken up and thought my actions to mean I woke up next to whomever might not have been a great idea but its not their fault. I went home with a friend one night from the pub and the next morning thought "its almost wrong he still took me home how drunk I was" but I've also gone home with him when he's been a mess and wondered if thats taking advantage.
I do think there are questionable morals in buying drinks for a person to get them drunk enough to sleep with them, there is a difference between buying a drink to start a convo/flirt and buying shot after shot after shot till they can't walk straight.
