i feel for the guy, he gave the person he loves something amazing, he whent though that risking alot and she cheated on him?!
but whats worse and the reason i can understand his upset is after giving her his kidney shes not trying to keep the kids from him and prevent him from seeing his children?

i think hes being petty demaning money for his kidney,
BUT i think she is worse, to accept such a thing then cheat on the man that gave it to you THEN threaten him with the kids cause he wants a divorse...

I think hes using it as a way of preventing her from taking the kids in his own round about and not nessicarily good way...trying to have some kind of bargaining chip in a battle that often feels, if not is...one sided

hes being whiney about it yes, but i can see why and i think the wife is a little screwed up for what shes done and is doing.

What everyone's losing sight of is that this is a legal tactic - and sometimes you have to file bizarre motions to get your point across, weird as it is.

And sometimes attorneys just have to do what their clients ask of them, too, although it can be risky if you file something that is judged to be frivolous.

Well, if the kidney gift (without compensation) is used as a bargaining chip to see the kids, I would think that a judge or the other lawyer would say, "irrelevant and immaterial." If he wants to see the kids, he has to go through the kid custody laws, not the kidney selling laws.:rofl1:

It's not that direct, lol. Sometimes the only way you get things to happen is to literally bury the other side in filings. They are compelled to answer - or at least request continuances to answer - within a limited time period.

The theory is - and it often works - that if you're enough of a nuisance you can force the other side to deal with the real issues just to get out from under the onslaught.

In this particular instance, it's also a clever method of getting the fact of the kidney donation to the attention of the judge - whereas under normal proceedings it would be inadmissible at worst, an obvious ploy for sympathy and a show of weakness at best.

He is a jerk, no matter the situation. He was paid with her life he had received with her, get over it dude.
He's a Jerk??? I think the door swings both ways.

He probably won't win, I don't think premarital property type stuff would apply to this, but she should have some decency. It's not like this is a family heirloom he gave as a gift, it was a freakin body part. Let him at least see his kids.

I don't see him as a jerk but as a very hurt person who is using this tactic to see his kids. I think the wife is a b*tch to think her kids don't need a father in their lives. I keep thinking that if something were to happen to him, accident or whatever and he lost the only kidney he has left he would be the one in big trouble. The kidney was a gift so I don't think he'll get money but I think he might stand a chance with the kids, which is probably all he really wants. Maybe I'm old fashioned or just plain old but I can't see myself ever hurting someone like this who gave me a second chance at life.

I feel for this guy. While no one in their sane mind can believe that he would get the kidney back, and probably won't see the money, I can definitely believe it's a legal tactic.

Personally, I think if she cheated on him she should get absolutely nothing out of the divorce. Kicked to the curb broke and jobless. And that's not even taking into account the fact that he saved her life....
