Yeah i get your point and i agree with you, you are right, lots of other people use sampling.
But i only hate it when rappers do it, that may not sound right but thats how i feell. I also feel that everyone who samples should get permission, thats messed up if they dont.
there's another tricky thing... you only have to get "permission" if you are planning on making money off of the song. Permission is generally pretty expensive, and if you aren't making money off of the music, then it's not something you need to obtain. That's how cover bands are able to perform at bars or conventions.
The DJ who's website i linked, doesn't have any cds circulating of his hybrids, where he's gotten permission for mixing the two songs. He has cds out there that he has burned himself of his hybrids but they have been gifts to friends... but he does not make money off of his hybrids. He may play them at the clubs where he spins but other than that...? He mixes the songs to create new versions of art... and he's an awesome DJ to boot. He very rarely messes up melding songs into one another all the beats align so as to keep a dance floor jumping.
Another band i know here in Madison, called
the Gothsicles, samples video game themes. They dont have permission for many of those themes either (i don't believe) but they still play at sci-fi cons, and local shows. They are also quite good, imho, but it's very much a fringe group... not for everyone... unless you like old video games and know what the Konami code is.
