I recently purchased a dvd box set through ebay from a seller in the UK. This particular packaging it out of print, and this guy had 10 to sell "brand new". It took 3 weeks to arrive (which I understand because of the distance), and it was in shrink wrap, but everything about the box set (inside and out) was dirty and damaged. After a few emails with the seller we came to the conclusion that I would return it for a full refund rather than getting a replacement (since I don't trust a replacement wouldn't come in the same condition). I sent it off today and it will take anywhere from a month to a month and a half to get to him. Naturally I don't expect him to refund my money until he gets it (which sucks for me, but oh well), but in the mean time I also opened a dispute with paypal to protect myself in case he changes his mind later (I question the authenticity of this set after having a good look so I'm not sure how much I trust this guy to keep his word). Since I only have 45 days from the date of the transaction to file anything through paypal I felt this was the best course of action. I informed the seller that the box set was mailed off today, and let him know I opened the dispute to "keep things official". He responded that I didn't need to open a dispute because he already told me he'd refund me when he got the dvd's.
So my question in the end is, is it wrong of me to open a dispute? As long he is true to his word and refunds me that shouldn't hurt the seller's rating should it? I can't imagine why else he'd have a problem with me doing this.
