Ebay/Paypal dispute

I recently purchased a dvd box set through ebay from a seller in the UK. This particular packaging it out of print, and this guy had 10 to sell "brand new". It took 3 weeks to arrive (which I understand because of the distance), and it was in shrink wrap, but everything about the box set (inside and out) was dirty and damaged. After a few emails with the seller we came to the conclusion that I would return it for a full refund rather than getting a replacement (since I don't trust a replacement wouldn't come in the same condition). I sent it off today and it will take anywhere from a month to a month and a half to get to him. Naturally I don't expect him to refund my money until he gets it (which sucks for me, but oh well), but in the mean time I also opened a dispute with paypal to protect myself in case he changes his mind later (I question the authenticity of this set after having a good look so I'm not sure how much I trust this guy to keep his word). Since I only have 45 days from the date of the transaction to file anything through paypal I felt this was the best course of action. I informed the seller that the box set was mailed off today, and let him know I opened the dispute to "keep things official". He responded that I didn't need to open a dispute because he already told me he'd refund me when he got the dvd's.

So my question in the end is, is it wrong of me to open a dispute? As long he is true to his word and refunds me that shouldn't hurt the seller's rating should it? I can't imagine why else he'd have a problem with me doing this.

I would have opened a dispute. It saves your ass if he goes back on his word. Who cares if it hurts his ratings, you did not get the same quality of product you expected anyways.

No it is not bad of you to open the dispute. It's protecting yourself, and since he already lied in the listing (about the condition) then it's fair of you to be prepared for him to lie again.

If/when he refunds your money, you can let paypal know the dispute has been resolved.........you can also leave him feedback at ebay accordingly. He should not be upset with you in the least at this moment, there are no 'dings' to his reputation right now.

When I brought up the condition he told me that it was indeed new from his distributor, since it was shrink wrapped. Obviously that's not my problem if his distributor is sending him crappy merchandise, but it almost makes me feel sorry for him if he honestly didn't know (but that's probably the eternal optimist in me that thinks more of people than I should). So I can't say he outright lied really since it was shrink wrapped.

I just hate conflict, so this sucks all around. Not to mention I really wanted that box set :( I just want to make sure I'm not doing anything unreasonable, but I don't think I am. I don't have any more reason to trust him than he does to trust me, so he should not be upset about this at all imo. Thanks guys :)

Can I jump in this with a q of my own? If u buy something off a person (not shop) where do you stand with refunds? I ordered a bag and they told me it'd fit 16" plus laptop with room to spare, mine is smaller than this n doesn't fit. So they messed up. Emailed seller over a week ago and no response. Was cheap, but its money I could use towards one I can use. No use for this bag.

Well, if you paid with Paypal you do have the option of opening a dispute. The item was misrepresented, therefore you do have grounds to file. Filing a dispute does not hurt the seller unless they don't want to settle the dispute.

If you have a valid claim, and the seller isn't willing to work with you, in most cases paypal will refund your money and take it from them. But like Labrynth said, you only have about 45 days to file so you might want to look into it asap.

EDIT TO ADD: At least that's how it was last time I had issues, if they've changed policy, I don't know.

You can file a dispute with paypal if the item you received is not as the seller advertised. They will send a message to the seller, and they have 20 days to resolve the matter. If they don't you can escalate it and paypal will settle the claim (that's my understanding anyways, I've never had to do this before).

Thanks! Seems petty cos it was less than $10 (no pound sign on my phone argh), but I don't want the bag. She sent me the dimensions after I msged her to ask so is saved in my inbox. Wasn't in the listing. I made a point to ask before I bought. Principle of the thing though lol

It's good that you asked in advance, and EXCELLENT that you saved the response ;) And it really doesn't matter if it's $10 or $100.......misrepresenting/making a mistake is on her, not you.

As far as I know, paypal will not refund shipping though, so that's going to be on you if you want to move forward.

I'll have a look in a min. Too lazy to move off the sofa right now.... but think she's had fair chance to respond, emailed her a week last weds asking about a return.

Yep, checked my messages - she says her 16 inch laptop fits, with charger, work and room to spare. Me thinks not.

Messaged them again saying I will raise a dispute if I haven't heard by Monday.

Feel mean lol
