Default Breeding contract question!

This came up in a group I read information on, and I wanted to know what the general idea is with folks on here about it.

The breeder sold a puppy to someone, now they want their money refunded because the puppy came down with an ear infection - breeder offered to pay for the ear infection medication and vet visit, but they want a complete refund.

So where does this stand? My personal thought on it is that it's not genetic and could be caused by the new owner, so it's not the breeders responsibility to refund the purchase price of the puppy...and I think the breeder is being generous by offering to help the vet bill for the infection since they aren't aware of where it was contracted.

I'm not sure if there was a health guarantee or a contract...but I think it's pretty silly to ask for a refund because of something that can easily be caught? Am I wrong to think this?

Usually a breeder's contract say the buyer has 3 days to get the puppy to a vet. If anything is wrong then the buyer has the option of returning for a refund. Not get a full refund and keep the puppy.

Also, if this isn't a new puppy and its really 'just' an ear infection, then the breeder has no responsibility in it anyway. That breeder is already being MORE than generous by offering to pay half of the vet bills IMO.

If it could have been caused by the breeder somehow (ie, pup caught it at breeder's house) I think it's fair for the breeder to pay for it or half of it if they neglected to get the pup vet checked. Refunding the entire puppy price? Uhhhhh no. Try again. LOL

Lord , they could have bathed the new puppy and got water in it's ear ! This is nit picking !!! I'd take the pup back and find a better owner !

I believe the new owners have had the puppy for about 3-4 weeks, so not like they picked it up yesterday. The breeder offered to pay for the entire vet bill also, not just half...which I think is pretty generous.

I wouldn't have expected Lily's breeder to do that after a month over something like an ear infection...I had to take her to the vet to get stitches and it resulted in a minor infection...not my breeders fault at all and I wouldn't ask for money back on her for it.

Personally I think these people are shady for wanting a refund...and not mentioning anything about returning the puppy.
Bubbatd, I think you are right, it is nitpicking, and an ear infection is pretty common to get with some breeds anyway. I think it would be silly to bring a puppy back over something like that, and just IMO if they are going to want a refund over an ear infection the breeder is better off getting the puppy back and refunding their money instead of dealing with their hassle.

So if you put in a contract that within 72 hours of purchase the puppy needs to see a vet for a check-up does that hold you harmless as the breeder if say in 3 weeks the puppy contracts an ear infection or something else that is not genetic?

Those new owners are batty !!! The breeder was VERY generous !!! I'd almost be tempted to take the pup back and find deserving owners !
