Default Court rules man can sue store he robbed

A man in Michigan tried to rob a store. It failed: he was shot twice and chased down by workers. He now wants to sue the store on the grounds that he was "excessively beaten". A judge has ruled he's allowed to sue. *mind boggles*

Judge: Mich. man can sue store he robbed - Crime & courts- msnbc.com

I think no matter what happens to you during an attempt to do something illegal like that(robbery, assalt, rape, etc...)you should have NO rights at that point. I don't care if they knocked you down and beat you to a bloody pulp leaving you in the hospital for a month!.

You know, I've had many people in Texas tell me, "If someone breaks into your house and tries to rob it, shoot 'em and kill 'em. If you let 'em live, they'll just sue."

I always thought they were joking. Then I see stories like this, and it really makes me wonder.

I agree with the ones who told you this. It's not that I am gun happy or want to take a life.........but the story you posted is a good example of WHY I agree with them!

Yup. There's a reason for that!

That article doesn't say much. Was he fleeing the scene and shot in the back? Trying to get away empty handed as he was chased down an beaten? Did he have any stolen money? Or was he just trying to get away with his life after he failed? If someone broke into my house, I'd shoot, but if I scared them away then what's the use in killing him other than to just take my anger out ? That is not self defence. Now, if he was trying to get away with my property, I'd try to take him down and get it back, with or without a gun. But if he's empty handed and running away, calling the cops and reporting it would be good enough. For me anyway.

That, I agree with. This is just one more example of what is so sick about our country. Infuriating!!!!

just because the judge granted him the right to sue doesn't mean he'll win. private citizens lack appropriate training and can't be held to the same standards of excessive force that police can. so even if the crook's crook scams a jury into finding for them the defendants can appeal on frivolous grounds and stand a good chance of winning. if they win the appeal they can then sue the crook's crook for their legal fees. this is dangerous ground for a lawyer but alot are young & dumb (too many going to law school w/ no common sense) and will take a shot at it. a lot will depend on the jury.
