Today, Judge McDonald voided the Louisville animal control ordinance
passed on 12/19/06, and all amended versions passed later, in an opinion
issued in the Open Meetings lawsuit brought by the Louisville Kennel Club and the League of Kentucky Sportsmen.

The Louisville Kennel Club will ask for a suspension of its federal
lawsuit until we see what the Louisville Metro Council does concerning an animal control ordinance. Meanwhile, all those who were cited, fined,
paid license fees, had their dog impounded or altered or had any other action taken against them under the voided law are entitled to get their
money back. We're hoping to see a class action suit soon.

A Jefferson Circuit Court judge has struck down Louisville controversial dog ordinance, ruling that members of the Louisville Metro Council violated the states Open Meetings Act by discussing the proposed ordinance without properly notifying the public.

Judge Martin McDonald found that council members did not post notice of
a Dec. 19, 2006, caucus meeting and only sent out an e-mail about the
location of the meeting three hours in advance to other members of the
caucus.

McDonald also said there is no evidence the council notified the media
of the meeting or its location, though at least one member of the media was present....

Although good news, especially for someone from Louisville, like me, it was stuck down on procedural grounds. They can just pass the dang thing agian if they want to . . .

Actually, the scoop is now that it did not remove another December 2007 ordinance that contained the same wording and requiremetns. Here is a link and I hope everyone who reads this will take time to vote in the survey and give their opinions. About 95% are in favor of the ordinance strikedown.
